United Optathlon Sweepstakes Official Rules



NO PURCHASE IS REQUIRED TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.



ELIGIBILITY:

Sweepstakes begins at 12:01 a.m. (CDT) on 7/19/2010 and ends at 11:59 p.m. (CDT) on 10/15/2010 ("Entry Period"). Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia, except that residents of Florida and New York are eligible only to win the Grand Prize and the First Place prizes, and who are at least the legal age of majority in their state of residence at time of entry. Employees of United Air Lines, Inc. ("Sponsor"), its subsidiaries and affiliates, and its advertising or promotion, agencies and any entity involved in the development, production, implementation, administration or fulfillment of the Sweepstakes (collectively "Sweepstakes Entities"), their subsidiaries and affiliates, their respective immediate family members (spouse, parents, siblings, and children, regardless of where they live) and persons living in the same household of such individuals, whether or not related, are not eligible to enter or win. Void where prohibited and subject to all laws.

HOW TO ENTER:

To register for and enter the Sweepstakes, access www.__games.united.com_____ (the "Website") either directly via a computer or via your iPhone® or Android® mobile device.. After playing at least one of the five Optathlon games (Economy Plus®, Award Accelerator®, Red Carpet Club®, Door-to-Door Baggage® and Premier Line®) via a method of your choice, you will automatically be entered into the Sweepstakes. Only the Economy Plus® and Premier Line® games are available via mobile access. Play and enter as often as you like, but there is a limit of one entry per person per day irrespective of method of entry. Sponsor is not responsible for garbled, incomplete, late, misdirected, lost or stolen entries. All entries become the property of Sponsor and will not be acknowledged or returned. To enter and play via mobile devices, users will be required to download the iPhone® or Android® mobile apps in the iPhone or Android online store(s), where there will be a unique url that points directly to the Optathlon mobile app download page. Apple is not a sponsor of, or responsible for conducting, the promotion. No third party entries or entries through a sweepstakes service permitted.

PRIZE:

Grand Prize: One randomly selected winner will receive One Million (1,000,000) Mileage Plus® miles, awarded as a credit to the winner's Mileage Plus account, and $5,000, which may be used toward the payment of applicable taxes if the winner so chooses. Approximate Retail Value (ARV) of miles: $20,000. Total ARV of Grand Prize is $25,000. If Grand Prize winner is not a Mileage Plus member, they will be required, at no cost, to become one so that the miles can be credited to their account. Three randomly selected First Prize winners will each receive their choice of an Economy Plus® annual option (ARV: $425) or a Red Carpet Club® membership (ARV: $475). Also, after playing all five of the games, eligible participants who enter directly via the website have a chance to win an instant prize, which is a ten percent e-certificate discount applicable to a future united.com flight purchase. Winners will see a screen that says they are an instant winner and a code will subsequently be e-mailed to them. Participants who are not Instant Winners will receive a screen notifying them of that. Instant Winners who entered via mobile device will have a chance to win an instant prize after playing each of the two games. Instant winners can choose either an (1) Economy Plus upgrade (if they are in-airport, they must show winning screen on their phone to a United gate agent, who will upgrade their ticket) (ARV=$9 to $109), (2) a Premier Line upgrade (same as above) (ARV=$19-$49), (3) a Red Carpet Club one-time pass (same as above except this will have an 15 digit code which the winner must also show to a Red Carpet Club agent for access to club) (ARV=$39-$50), or (4) an e-certificate discount, which will be emailed to the winner. Any difference between a stated approximate retail value and the actual value of prize will not be awarded. Winners are responsible for all federal, state, local and other taxes. Grand Prize winner will receive an IRS 1099 Miscellaneous Income form reflecting the ARV of the prize, whether or not they actually use the entire prize. All prizes must be accepted as awarded and all or any portion of a prize not accepted or used by a winner will be forfeited.

DRAWING:

Approximately ten days following the Entry Period, a random selection of winners will be supervised by a third party administrator, whose decisions are final in all Sweepstakes related matters, from all eligible entries received from both methods of entry. Odds of winning Grand Prize and First Prizes depend on the total number of eligible entries received during the Entry Period. Odds of winning Instant Win prizes depend on the total number of eligible entries received, except for entries from Florida and New York residents.

PRIZE CLAIMS:

Each potential winner will be notified via traceable method of delivery, and will be required to complete, sign and have notarized an Affidavit of Eligibility, Liability and, where legal, Publicity Release, which must be returned within seven (7) calendar days of the notification date. Failure to return such documents within the specified time frame, as well as return of any notification as undeliverable, or the inability of Sweepstake Entities to contact the potential winner, will result in prize forfeiture and Sponsor may randomly select an alternate winner. If a prize is won by a person who is not of the legal age of majority in the state of residence, the required documents must be signed by winner's parent or legal guardian, and the prize will be awarded in the name of his/her parent or legal guardian, who will be required to fulfill all requirements imposed on the winners as set forth herein.

PRIZE RESTRICTIONS:

Prizes do not include insurance, gratuities, incidental charges or any other personal expenses associated with use of the prize. Prizes may not be transferred or substituted except at the sole discretion of Sponsor, which reserves the right to substitute any prize, or portion thereof, with a prize of equal or greater value, should the prize or any portion thereof, be unavailable. Reporting and payment of all applicable taxes, fees, and/or surcharges, if any, arising out of, or resulting from acceptance and/or use of a prize are the sole responsibility of the winner. Use of miles is subject to the rules of the United Mileage Plus program, including, but not limited to blackout dates, taxes, fees and restrictions. All additional taxes and fees, if any, related to travel using awarded miles are the responsibility of the passenger. Prize cannot be used in conjunction with any other promotion or offer and may not be separated. Tickets issued or accommodations awarded in conjunction with the prize are not eligible for frequent flyer, frequent guest or similar awards programs. Limit one alternate prize per passenger per promotional period. Limit one instant prize per passenger per day. Economy Plus and Premier Line prizes are valid only on one leg of round-trip travel. All prizes must be accepted as awarded. If a winner cannot or does not want to accept the prize as stated, then the prize will be forfeited.

GENERAL TERMS:

By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Sweepstakes Rules, participant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules (whether of the State of Illinois or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Illinois. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Cook County, Illinois. By participating in the Sweepstakes and accepting a prize, winners agree to (a) abide by the Official Rules and the decisions of the Sponsor, which shall be final in all Sweepstakes related matters, and (b) to release, discharge and hold the Sweepstakes Entities harmless from and against any/all claims, demands, causes of action, losses, injuries, death and damages, including, without limitation, actual, direct, indirect, consequential, punitive, or special, resulting from the acceptance, possession, use, non-use or misuse of any prize or any prize-related activities or travel. Except where prohibited by law, participants, or if a minor, his/her parent or legal guardian, grant Sweepstakes Entities the right to use and publish their name, city, state and likeness for advertising, promotion and publicity purposes in all media now or hereafter known throughout the world in perpetuity, without notification, right of review or approval, or additional compensation or permission. Sponsor's computer will be the official promotion time clock. For purposes of these Official Rules, "receipt" of an online entry occurs when Sponsor's servers record the entry information. Any automated computer receipt (such as one confirming delivery of email) does not constitute proof of actual receipt by Sponsor of an online entry. Every entry must be manually keystroked by entrant. Automated entries (including but not limited to entries submitted using any bot, script, macro, or Sweepstakes service) and third party entries are not permitted and will be disqualified.

LIMITATIONS OF LIABILITY:

The Sweepstakes Entities are not responsible for any incorrect or inaccurate information caused or submitted by Website users or attributable to telephone equipment or programming associated with or utilized in the Sweepstakes; any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access of the Website, or for interrupted or unavailable network, server or other connections, miscommunications, failed telephone or computer hardware or software or telephone transmissions or technical failures, internet service provider/network/website accessibility or availability, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic, including, without limitation, the incomplete, incorrect or inaccurate capture of entry information. Sponsor reserves the right, in its sole discretion, to disqualify any individual found tampering (or attempting to tamper) with the entry process, the Website, or the Sweepstakes. Any attempt by an entrant to deliberately damage the Website or undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek all legal remedies and damages from any such entrant to the fullest extent permitted by law. Sponsor reserves the right, at its sole discretion, to cancel/suspend/modify the Sweepstakes, if it becomes corrupted in any manner, or due to fraud or other occurrences beyond Sponsor's control, cannot be conducted as intended. In the event of cancellation, Sponsor will award the prizes in a random drawing from all eligible entries received prior to cancellation. In the event of a dispute regarding the identity of the person submitting the entry, the entry will be deemed submitted by the Mileage Plus Member under whose name or membership number the entry was submitted. Any promotional materials, including the offer or these Official Rules, which contain production, printing, or typographical errors are void; and Sponsor's liability, if any, is limited to the replacement of such materials. Recipients of such materials release the Released Parties from any and all losses, claims or damages that may result therefrom.

Terms and Conditions for Ten Percent e-Certificate Discount Prizes

  1. Permitted Travel Area: Travel is permitted within the United States. Purchase is valid on U.S. point-of-sale only.
  2. Discount Amount: Ten Percent (10%) off a qualifying round trip domestic purchase. The discount applies only to the base fare, and not to any taxes, fees or surcharges, including, but not limited to Passenger Facility Charges (PFCs), departure and arrival taxes and carrier-imposed surcharges. Total price shown on united.com is inclusive of excise taxes, fees and surcharges.
  3. Eligibility Restrictions: This discount may only be applied to the purchase of new tickets and may not be applied to a previously issued ticket.
  4. Valid Carrier: United® and United Express® only. Not valid on flights operated by other airlines, such as United-Marketed code share and Star Alliance Flights.
  5. Ticketing Dates: July 12, 2010 through December 31, 2010.
  6. Travel Dates: July 12, 2010 through December 31, 2010.
  7. Blackout Dates: Per rule of fare purchased.
  8. Advance Purchase: Per rule of fare purchased.
  9. Min/Max Stay Requirements: Per rule of fare purchased.
  10. Valid Routing: Any permitted United routing.
  11. Stopovers: Per rule of fare purchased.
  12. Qualifying Fares: This discount may be used on the following published United First® (F,A) class, United Business® (J,C,D,Z) class United Economy® (Y,B,M,E,U,H,Q,V,W,S,T,L,K) class fares.
  13. Restricted Fares: This discount may not be used on the following fares: companion, travel industry G class, contract, bulk, convention, tour conductor, children, family plan, government, group, military, tour basing, senior discount, student, youth, infant, Around the World, Circle the Pacific, Visit USA, or any non published fares.
  14. Additional Taxes and Fees: All taxes, fees and carrier imposed surcharges are additional.
  15. Fare Rules: All rules of the fare purchased apply.
  16. Combinability: Not combinable with any other discount offers.
  17. Maximum number of uses per certificate: One
  18. Maximum number of passengers per itinerary: 6, all passengers must be ticketed in the same reservation/record locator
  19. Ticketing: Discount only applies when ticket is purchased within the 50 United States. All dollar levels are stated in U.S. currency.
  20. Residual Value of Certificate/Discount: When the discount certificate amount is greater than the cost of the ticket, the difference will be forfeited.
  21. Mileage Plus® Accrual: Permitted
  22. Upgrades: To determine if the fare purchased with this discount allows the use of an upgrade certificate, refer lathe terms, conditions and booking class restrictions associated with the upgrade type you are using.
  23. Changes: Rules of the fare determine if changes are permitted. If changes are allowed, there may be service charges and fees associated with a change. You will receive the value of the discounted ticket, less any of the aforementioned service charges and/or fees, towards the purchase of a new ticket.
  24. Refunds: This discount is non-refundable. Once used, the discount will not be reissued for future use. Any refund due is based on the amount actually paid, minus any service fees. The discount may not be applied toward the purchase of another ticket when exchanging or refunding your original ticket, except when the original ticket qualifies for a reduced fare (guaranteed airfare rule applies).

  1. The Pass grants one person one-time access to the Red Carpet Club
  2. Access subject to space availability
  3. Valid at any United Red Carpet Club worldwide. Excludes United Arrivals Suite and United First International lounges
  4. You must be 18 years of age or older to redeem
  5. Void if altered, bartered or sold
  6. Lost or stolen passes will not be replaced or redeemed for cash or credit
  7. The pass is subject to United Red Carpet Club terms and conditions, which United has the right to amend or modify with or without notice to its customers
  8. You must hold a same day ticket for air travel that allows clearance through airport security
  9. One-Time Pass must be presented and surrendered upon use
  10. One-Time Pass is non-refundable

Terms and Conditions for Economy Plus and Premier Line:

  1. Prizes are subject to availability. If a participant wins an Economy Plus upgrade and there is an Economy Plus seat available on his or her flight, the passenger will receive it. If not, then the participant will be upgraded to Premier Line.
  2. Economy Plus and Premier Line are valid only on the date the instant win prize is awarded.
